He cannot issue an ordinance , when both the Houses of Parliament are in session. Every ordinance issued by the President should be laid before both Houses of Parliament, within six weeks of re-assembly of Parliament . The president may also withdraw an ordinance at any time he likes.

There are many reasons why a constitution is needed. One of the primary purposes is to define and limit power of the government.

It gives the structures for the functioning of the country such as courts and parliament and limits the power.

e.g. to imprison without trial for the government.

Article-22 :: Protection against arrest and detention.

No person who is arrested shall be detained in custody without being informed of the grounds for such arrest nor shall he be denied the right to consult and to be defended by a legal Practioner of his choice.

The Council of States (Rajya Sabha) is composed of not more than 250 members, of whom 12 are nominated by the President. The twelve members are chosen by him from among persons having special knowledge or practical experience in literature, science, art, and social service. The Constitution thus adopts the principle of nomination, for according distinguished Indians a place in the Upper Chamber (Rajya Sabha) of Parliament.
